I have kept the mystic power based speculation, but I don't see how not being apprehended by authorities during the Enelsion Attack can be used as proofing mechanism for power types. Lots of super-heroes evaded lockup, and their power base is broad, most not mystic at all.

Was there some commentary that Brian made in his narration somewhere that I am forgetting about?

It was from the tv report saying which heroes and the cover to issue 8 which heroes they hadn't captured or shut down. I know Samaritan was still out and about, but the three that were mentioned were the Confessor, The Hanged Man and The Gentleman. At this moment can't recall if it was stated, but the Confessor and Hanged Man seem to fit. So thats where that came from...
